The Penalties of a Commercial DWI Conviction

Commercial drivers are required to hold a valid commercial driver’s license (CDL), which they depend on to earn a living. For this reason, there is much more at stake in a commercial DWI case when compared with a standard one.

Commercial drivers cannot operate a vehicle with a blood alcohol concentration of .04 or higher. If they are suspected of a DWI, the following penalties will apply:

First-time DWI conviction:

  • Fines up to $1000
  • CDL suspension of at least 1 year
  • Up to 1 year in jail

Chemical test refusal:

  • $550 fines
  • CDL suspension of at least 18 months

Chemical test refusal within 5 years of a previous DWI-related charge:

  • $750 fines
  • Permanent CDL suspension
